Supreme Court Upholds Wammako’s Victory in 2007 Poll

THE Supreme Court on Friday dismissed the fresh application brought by the Democratic Peoples Party (DPP) gubernatorial standard-bearer in the 2007 Sokoto election, Alhaji Mahammad Maigari Dingyadi, against Governor Aliyu Wamakko.

Dingyadi had, through his counsel, Chief Akin Olujimi (SAN), approached the apex court asking it to reverse itself on its November 26, 2010 judgment dismissing his appeal at the Court of Appeal, Sokoto division

Joined as respondents in the suit were the Independent National Electoral Commission (INEC), Governor Wamakko and the Peoples Democratic Party (PDP).

The applicant claimed that the apex court lacked the jurisdiction to dismiss his appeal which emanated from the judgment of the Sokoto election petition tribunal.

When the matter came up for judgment on Friday, the panel of five justices headed by Justice Chukwuma-Eneh unanimously dismissed the application for lacking in merit.

In arriving at this decision, Justice Oyelola Adekeye, who read the lead judgment said,”…this court has restated in many cases that it possesses inherent power to set aside its judgment in appropriate cases. The rationale behind the inherent power was amplified in the case of Adegoke Motors Ltd V Adesanya & Anor (1989) 5 SC pg. 113.”
