EFCC arraigns three over $.7m generator fraud

The Economic and Financial Crimes Commission on Tuesday dragged to court three suspects charged with fraud and stealing of nine containers of gasoline generators valued at $713,007, belonging to a China-based exporter.

The accused, Messrs Henry Akinduro, 33; Oladotun Ojuri, 46; and Raphael Obiakalusi, also 46, were arraigned on a five-count charge before a Lagos High Court in Ikeja.

The exporter, Fujian Tiger Power Machine Group Co. Ltd, China was said to have secured a deal to ship the generators to an importer based in Ibadan, His Grace Integrated Solution Ltd, represented by Akinduro.

A shipping company which shipped the cargo from China, CMA CGM, had petitioned the EFCC, alleging that the accused were involved in stealing nine out of the 10 containers of the generators.

The petitioner said it shipped the containers on behalf of the exporter, FTPMGC Ltd into the custody of a Nigerian company, Michelle Bonded Container Terminal, in June 2009. Michelle Bonded Container is the operator of the Michelle Bonded Warehouse, Orile Lagos.

Oludotun as the Terminal Manager of Michelle Bonded Terminal Ltd allegedly facilitated the release of nine out of the containers to Akinduro in June 2009 without presentation of the original Bill of Lading.

Obiakalusi, the EFCC said, got involved in the matter by allegedly forging a letter of indemnity dated November 23, 2009 to Michelle Nigeria Ltd to facilitate the alleged stealing.

The petitioner had asked the EFCC to investigate the matter, adding that the fraud perpetrated by the accused had denied the exporter of its full payments.

The court, presided over by Justice Funmilayo Akinlade, on Monday asked the accused to remain in Kirikiri Maximum Prison, Lagos till April 14 when the matter would be brought before the court again.

The lawyers to the accused persons had pleaded for their bail, saying that they had been remanded in prison since February 17.
