Atiku Asks Court to Dismiss Suit Against Waiver
Latest Politics Sunday, January 9th, 2011Former Vice President Atiku Abubakar, on yesterday asked an Abuja high court to dismiss a suit filed by Peoples Democratic Party’s chieftain, Alhaji Sadiq Aliyu Jada, seeking to nullify the waiver grant him by the party.
In a preliminary objection filed by his lawyer, Mr. Rickey Tarfa SAN, Atiku said that the suit lacked merit.
Jada had in his suit said that the party did not follow due process in granting waiver to Atiku.
But the former vice president disagreed. He said that the party had complied with its constitution in granting him waiver.
Atiku argued that if it was true that the party did not follow due process in admitting him into the party, the best place to lay a complaint was before the party itself.
He therefore asked the court to dismiss the case on the ground that the plaintiff had not exhausted internal mechanism for resolving disputes before heading for the court.
His lawyer, Tarfa said, The Plaintiff had argued that he had explored the internal mechanism of the party. He did this without supplying documents showing that he had done so. The internal mechanism provided for under the PDP constitution is quite explicit and graduates from one lower level of the party to a higher one until the procedure is exhausted at the highest level.
