Certificate Forgery Suit Against Suswam Withdrawn
Benue, State News Thursday, January 27th, 2011The defeated Peoples Democratic Party (PDP) governorship aspirant in Benue State, Mr. Terver Kaki, Monday withdrew his case of certificate forgery against Governor Gabriel Suswam at the Federal High Court in Makurdi.
At the resumed sitting of the court, counsel to Mr. Kaki, Mr. Samuel Kagbo, on behalf of his client, told the court that he had filed a notice to discontinue the case.
In an affidavit brought on notice, one of the counsel to Governor Suswam told the court that the plaintiff’s counsel had filed a motion on notice to discontinue the case.
The presiding Federal High Court judge, Justice Abinbola Obaseki, sought to know if all parties were aware of the notice, and struck out the case accordingly having received no objection from all the counsel.
Speaking to journalists after the sitting, Suswam’s lead counsel, Mr. Tony Ijohor, SAN, said the plaintiff only wanted to harass and intimidate his client, the governor.
In his reaction outside the court premises, the state Attorney General and Commissioner for Justice, Mr. Chive Kaave, who was the defendant to the case, told the litigant to stop wasting the time of the court when he knew that he had no case. Reacting to the judgement, counsel to the plaintiff, Mr. Samuel Kagbo, told journalists that the case was still alive, and that his client would still approach the court again.
Mr. Kagbo said the case was filed wrongly by his client and would be re-arranged and filed in another court.
