Igbinedions: Court Bars Further Publication of Alleged Defamatory Materials
Headlines Saturday, March 5th, 2011A Benin, Edo State High Court, on Friday, issued an interim injunction restraining further publication of the crisis that has engulfed the marriage between daughter of the Esama of Benin, Chief Gabriel Igbinedion, Omosede and her husband, Prince Avan Akenzua II.
In suit no B/156/M1/2011 between Chief Gabriel Igbinedion, Lady Cherry Igbinedion and Mrs. Omosede Igbinedion-Akenzua as plaintiffs/applicants, the Igbinedions sought an order of interim injunction against the defendants, Prince Avan Akenzua II, Lagoon Press Limited and three others from further publication on the marriage.
According to the court, the order of interim injunction would subsist pending the hearing and determination of the motion on notice.
In his ruling, Justice Roland Amaize said after a careful study of the facts deposed to in a 12-paragraph affidavit, “an interim injunctive order is hereby issued restraining the defendant in this suit, be by themselves, their agents, servants, employees and/or privies from any further publication of the subject matter of the suit or any publication of any matter considered defamatory of the plaintiffs against the said plaintiffs in whatever form wheresoever and howsoever, in any newspaper, magazines or other print as well as electronic media and/or in the internet, pending the hearing and determination of a motion on notice for interlocutory injunction.”
Besides, Justice Amaize fixed hearing on the motion on notice for March 11.
