Alleged fraud: Court strikes out suit against Jim Iyke
Headlines, Nollywood (Film Industry) Wednesday, July 4th, 2012An Abuja chief magistrate court on Tuesday, struck out the suit brought against Nollywood top actor, Jim Iyke, over alleged criminal breach of trust, criminal force and assault, criminal intimidation and criminal misappropriation.
The presiding magistrate, Azubuike Okeagu struck out the matter, after parties involved had a settlement of the case.
The police had brought a First Information Report (FIR) before the court, seeking to establish a prima facie case against Jim Iyke. However, none of the charges against him could be proved, and following a letter by the nominal complainant in the case, Habiba Abubakar, asking that the charges be withdrawn, the court had no other option than to strike out the case.
According to counsel to Abubakar, Danjuma Etobi, ”there was a document prepared by counsel to the nominal complainant and addressed to the Assistant Superintendent of Police (ASP) Zone 7 Police Headquarters, dated May 7, 2012, and received him on May 8, 2012. It was minuted to the deputy Commissioner of Police in charge of the Criminal Investigative Department and finally to the Officer-in-Charge of legal, who then handed the document to me on May 15, 2012.
“The document instructed me to comply with the instructions on the document, which directs that the case be withdrawn. Therefore, under Section 130 of the Criminal Procedure Code (CPC), owing to the circumstances and instructions of my superiors, I apply to terminate the case CR No 366/2011, which was brought before this court on November 10, 2011.
Counsel to Iyke, Esther Uzoma, told the court that she has no objection to the termination of the case and the Chief Magistrate subsequently struck out the matter.
